Port Legislation and Regulations

The basic foundational moment of current legal port regulations comes from Law 27/1992, of November 24, on state ports and the merchant marine, to which there have been different partial reforms through other laws: Law 62/1997, of December 26, modifying Law 27/1992, of November 24, on State Ports and the Merchant Marine; Law 48/2003, of November 26, on the ports' financial structure and on provision of services of general interest, and Law 33/2010, of August 5, modifying Law 48/2003, of November 26, on the ports' financial structure and on provision of services of general interest.

After this process of regulatory evolution, the regulation of the structure and management of the state port system is based on Royal Legislative Decree 2/2011, of September 5, by which the Revised Text of the Law on State Ports and the Merchant Marine (TRLPEMM due to its Spanish initials) is approved.

Lastly, the TRLPEMM has been the object of successive specific modifications=: Law 2/2012, of June 29, on General State Budgets for the year 2012; Law 17/2012, of December 27, on General State Budgets for the year 2013; Law 2/2013, of May 29, on the protection and sustainable use of the coastline and on the modification of Law 22/1988, of July 28, on Coasts; Law 22/2013, of December 23, on General State Budgets for the year 2014; Organic Law 9/2013, of December 20, on controlling the trade debt in the public sector; Royal Decree Law 1/2014, of January 24, on the reform in the area of transport and infrastructures, and other economic measures; Order FOM/163/2014, of January 31, by which annex III of the Revised Text of the Law on State Ports and the Merchant Marine (approved by Royal Legislative Decree 2/2011, of September 5) is approved; Royal Decree Law 8/2014, of July 4, approving urgent measures for growth, competitiveness and efficiency; Law 14/2014, of July 24, on Marine Navigation; Law 18/2014, of October 15, approving urgent measures for growth, competitiveness and efficiency; Law 36/2014, of December 26, on General State Budgets for the year 2015.
